These Terms and Conditions ("Terms") govern the relationship between JL & KC Enterprises, LLC (doing business as "Revved Up Reviews," "we," "us," or "our") and the business entity or individual ("Client," "you," or "your") purchasing our services. By enrolling in any plan (Ignition, Full Throttle, or otherwise), you agree to be bound by these Terms.
1. Scope of Services
Revved Up Reviews provides a managed marketing and reputation platform. Our services include, but are not limited to, automated review requests, AI-driven review responses, Google Business Profile (GBP) management, and social media content automation (the "Services").
2. Limitation of Liability (CRITICAL)
To the maximum extent permitted by law, JL & KC Enterprises, LLC and its members, managers, and employees shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to:
-AI-Generated Content: We use Artificial Intelligence ("AI") to draft review responses and social posts. You acknowledge that AI can produce errors or "hallucinations." You are responsible for reviewing all automated content. We are not liable for the accuracy or tone of AI-generated messages.
-GBP Status & Suspensions: Google’s policies change frequently. We are not responsible for any suspension, delisting, or ranking drops of your Google Business Profile or other social profiles. Google’s actions are final and outside of our control.
-Third-Party Platforms: Our service relies on third-party providers (e.g., GoHighLevel, Climbo, Twilio, Google, Meta). We are not liable for outages, data loss, or price changes from these providers.
-Review Filtering & Gating: We provide a "Feedback-First" system. You agree that you are responsible for ensuring your use of this feature complies with the terms of service of third-party platforms like Google or Yelp. We are not liable for penalties resulting from "review gating" or "filtering" practices.
-In no event shall our total liability for any claim exceed the amount paid by you for the three (3) months of service preceding the claim.
3. Client Responsibilities
Review of Content: You agree to monitor the responses our system sends and notify us of any errors.
A2P 10DLC Compliance: You are responsible for providing accurate business information for SMS carrier registration.
Data Accuracy: You represent that any customer contact list you provide was collected legally and that those individuals have consented to receive communications.
4. Indemnification
You agree to indemnify, defend, and hold harmless JL & KC Enterprises, LLC from any claims, losses, or legal fees resulting from your use of the Services, your violation of these Terms, or your violation of third-party platform policies (e.g., Google's Terms of Service).
5. Payments, Refunds, and Cancellation
No Contracts: Services are provided on a month-to-month basis.
Refunds: Due to the "Done-For-You" nature of the setup and service, all payments are non-refundable.
Cancellation: You may cancel at any time via your dashboard or by providing written notice 5 days before your next billing date.
6. Governing Law
These Terms shall be governed by the laws of the Commonwealth of Virginia. Any legal action shall be brought in the courts located in Winchester, VA.
